Anyway, below we provide you with the primary information for foreigners who wish to legally get married in the city of Rome.

What documents are needed to get married in Rome with a civil and legal marriage?

1) According to Presidential Decree n 396/2000 you will need to sign a sworn declaration of wanting to contract a civil wedding in Rome for non-resident foreigners who are not subject to the obligation of public banns (if one of the future spouses is resident public banns must be done).
Unlike many other municipalities, the Municipality of Rome allows the declaration mentioned above without the presence of the spouses and consenting your wedding planner to sign it with a power of attorney signed by you. Therefore, the sworn declaration (for non resident foreigners) can be signed by your wedding planner in Rome for sure.

2) As provided for by Article 116 of the Italian Civil Code, for foreign spouses, the Nulla osta to marriage or the certificate of marriage capacity (for countries adhering to the Munich Convention) will be required, both issued by the country of origin. Some exceptions are provided if the country of origin has joined the Hague Convention or the London Convention. Specific exceptions are also made for American citizens and Australian citizens.
A copy of valid identity documents and passports for non-EU citizens will be required.

The celebrations of legal marriage ceremonies are possible at the following times:

– Friday: from 9:00 to 12:30 and from 16:00 to 18:00
– Saturday: from 9:00 to 12:00 and from 16:00 to 18:00
– Sunday: from 9:00 to 12:30

The celebrations of legal marriage ceremonies are possible at the following times:
– Wednesday: from 9:00 to 12:30
– Thursday: from 9:00 to 12:30
from 1 June to 30 September also from 16:00 to 18:00
– Friday: from 9:00 to 12:30 and from 16:00 to 18:00
– Saturday: from 9:00 to 12:00 and from 16:00 to 18:00
– Sunday: from 9:00 to 12:30
The hall is closed for civil and religious holidays.

Costs and payment methods for the legal marriage of foreigners in Rome

The Council Resolution no. 312 of 31/12/2019 has set the following rates for the celebration of civil marriage and civil unions in the rooms as mentioned above:
• if at least one of the spouses is resident in Rome: € 150.00;

• if at least one of the spouses is a resident of the Province of Rome:
– € 300.00 for weddings celebrated on weekdays
– € 500.00 for weddings celebrated on Saturday and Sunday

• if none of the spouses are resident in Rome or in the Province of Rome:
– € 1,200.00 for weddings celebrated on weekdays
– € 1,400.00 for weddings celebrated on Saturday and Sunday

The rates for weddings to be celebrated at the “Spiaggia degli Sposi” in Ostia are as follows:
• if at least one of the spouses is resident in Rome:
– € 350.00 for weddings celebrated on weekdays;
– € 400.00 for weddings celebrated on Saturday and Sunday.
• if at least one of the spouses is a resident of the Province of Rome:
– € 500.00 for weddings celebrated on weekdays;
– € 600.00 for weddings celebrated on Saturday and Sunday.
• if none of the spouses are resident in Rome or in the Province of Rome:
– € 700.00 for weddings celebrated on weekdays;
– € 800.00 for weddings celebrated on Saturday and Sunday.

According to Council Resolution no. 244 of 07/30/2010, marriage is free of charge when celebrated at the Marriage Office of the Town Hall to which it belongs. The procedures for requesting publications have been carried out on days when it is open to the public.

How does civil union work (the so-called same sex wedding) in Rome?

Who can apply for the constitution of a civil union?

People of the same sex of age, both Italian and foreign, capable of acting, can apply for a civil union.
There is no need to produce any documentation for Italian citizens as it will be acquired ex officio.

However, foreign citizens must attach in original to the request for an appointment a nulla osta issued by the competent diplomatic authority of their country present in Italy (Consulate) showing that, under the laws to which they are subject, nulla osta for civil union (art.116 of the Italian Civil Code).

According to the law of the State of which the foreigner is a citizen, the production of the nulla osta is precluded due to the non-recognition of the civil union. In that case, the nulla osta is replaced by a certificate or other document suitable for certifying the freedom of State or by self-declaration according to the DPR n.445 of 28/12/2000. The document must contain the complete personal details of the interested party. It must be in compliance with the provisions relating to legalization or any specific conventions on the subject.

Causes impeding the establishment of the civil union:

– the existence, for one of the parties, of a marital bond or a civil union between persons of the same sex;
– the interdiction of one of the parties for insanity;
– the existence between the parties of relationships of kinship, affinity, and adoption referred to in article 87, first paragraph, of the civil code; they cannot contract a civil union uncle and nephew and aunt and nephew; the provisions of the same article 87 apply;
– the definitive sentence of a contractor for a murder committed or attempted against whoever is married or civilly united with the other party.
The existence of one of the aforementioned impeding causes entails the nullity of the civil union.
